Introduction

These conditions are valid exclusively between the company SMIT BOWLING SRL, with registered office in Via del Passetto n. 111- 47897 Fiorentino (Republic of San Marino), C.O.E. SM30616, hereinafter referred to as ''SMIT BOWLING'' and any person who makes online purchases on the website www.smitbowling.com hereinafter referred to as ''CUSTOMER''.

These general terms and conditions of sale (hereinafter only ''General Terms'') govern the sale of products marketed by www.smitbowling.com. All purchases of products concluded through the website www.smitbowling.com, and in accordance with the procedures specified therein, shall be governed by these General Conditions.

Acceptance of the General Conditions of Sale

The contract concluded between SMIT BOWLING and the Customer shall be deemed concluded with the acceptance, even partial, of the order by SMIT BOWLING which reserves the right, at its sole discretion, to accept the order. Acceptance shall be deemed tacit unless otherwise communicated in any manner to the Customer. By placing an order in the various ways provided, the Customer declares that he/she has read all the information provided during the purchase process and fully accepts the terms and conditions (general and payment) transcribed below. If the Customer is a final consumer (i.e. an individual who purchases goods for purposes not related to his professional activity), once the online purchase procedure is completed, he will print or save an electronic copy and, in any case, keep, these general conditions of sale, in accordance with the provisions of art. 7 of Legislative Decree no. 206/2005 on distance selling. Any right of the Customer to damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance, even partial, of an order.
 

Mode of purchase

The Customer may purchase only the products in the electronic catalog of www.smitbowling.com at the time of placing the order and viewable at www.smitbowling.com, as described in the relevant information sheets. SMIT BOWLING reserves the right to change/adapt the technical information of the products to match that provided by the manufacturers, without the need for any prior notice. It is understood that the picture accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics, and differ in color, size, accessory products in the picture. The information supporting the purchase is intended as mere general information material. The correct receipt of the order is confirmed by SMIT BOWLING through an automatic e-mail response, sent to the e-mail address provided by the Customer during the order process. This confirmation message will contain the Date of execution of the order and an Order Number, to be used in any further communication with SMIT BOWLING. The message will repeat all the data entered by the Customer, who agrees to verify their correctness and promptly notify any corrections to the email address ordini@smitbowling.com. The Customer may also check the status of his order by accessing the web area dedicated to him. To access the dedicated area it will be necessary to Login from the site and then choose the item “My Orders”. In case of non-acceptance of the order, SMIT BOWLING undertakes to promptly notify the Customer in the same manner. All prices on the site are to be understood as prices to the public and, therefore, inclusive of single phase San Marino, excluding shipping costs. SMIT BOWLING reserves the right to change prices at any time, without prior notice. Changes in prices may not result in customer claims. At www.smitbowling.com, the availability or non-availability of various items is visible at the time of ordering. Since the simultaneous access of many user-customers and the simultaneous possibility of “on-line” orders, change the availability of the product, SMIT BOWLING does not guarantee the certainty of allocation of the ordered goods, until the order itself is visible in the area “My Orders” with indication ORDER CONFIRMED, provided that the payment methods have been successful. On certain products, subject to price promotions, SMIT BOWLING reserves the right to accept orders by reducing their quantities, subject to prior notice and acceptance by the Customer, failing which the order shall be deemed cancelled.

Methods of payment

PAYMENT BY BANK TRANSFER IN ADVANCE
The order is to be considered accepted only when the order itself will be visible in the “My Orders” area with indication PENDING. At that point the Customer will make payment by Bank Transfer. What is ordered by the Customer is kept committed until proof of transfer is received. The dispatch of what has been ordered takes place only upon actual crediting to the account of SMIT BOWLING, which must take place within 7 working days from the date of acceptance of the order. Beyond these deadlines, the order is deemed automatically cancelled.

The reason for the bank transfer must include the SURNAME of the payer and the ORDER NUMBER that is issued in the order confirmation email.

CASH ON DELIVERY PAYMENT
Cash on delivery payment in CASH, upon receipt of the goods, as required by current regulations, can only be accepted for amounts up to € 999.99 and requires an additional contribution of 1% of the total order with a minimum of € 1.00. The courier only accepts exact sums corresponding to the amount of the order (no return of change). For orders over EUR 500.00, we reserve the right to require a deposit by bank transfer in advance.

Delivery and shipping costs

Our shipments are made Monday through Friday by BRT Executive express courier with expected delivery in 24/72 hours. They may be subject to change due to force majeure or due to traffic conditions and road conditions in general or by act of the Authority.

Users outside the Italian territory (excluding Vatican City, Rep.San Marino) may confirm any purchases only with shipping address in Italy. Shipping starts only after receiving payment and in case of payment on delivery. Shipping costs are the responsibility of the Customer, except for current promotions. Also regarding any returns, changes or repairs.

When ordering, the Customer has the option to request that the goods travel with Insurance Coverage. In this case a surcharge of € 5.00 will be applied to the shipping cost. Shipments traveling with insurance coverage are insured all risks (total and/or partial damage, total and/or partial loss, total and/or partial theft, robbery) up to a maximum of € 1,500 per shipment, without deductible and uncovered. In case of damage, the written report of the damage suffered must be made by the Customer within 5 days of receipt of the shipment. For all shipments covered by WARRANTY in case of damage will be forwarded procedure for reimbursement. Shipments not covered by warranty are not refundable and the Customer who chooses this mode of shipment assumes responsibility for any loss of the package sent.

Deliveries are understood to be made on the ground floor. In case of absence, a notice is left and delivery is retried in the next 24/36 hours; in case of further absence, a notice is again left. Goods that cannot be redelivered to the consignee, for any reason not attributable to the carrier, as well as goods awaiting instructions from the sender, will remain in storage at the BRT location of destination for up to 5 working days within which the Customer must agree to a new delivery. Otherwise, the package will return to the sender. The Customer may contact SMIT BOWLING to request that the goods be held at the destined BRT branch and then pick up at the location. It is not possible to make arrangements directly with the BRT location. Any re-deliveries of goods will be charged all related charges as they are treated as a new shipment. It is possible to request firm delivery to the BRT branch closest to the Customer by specifying it in the notes at the conclusion of the order. No responsibility can be attributed to SMIT BOWLING in case of delay in the fulfillment of the order. Upon delivery of the goods by the courier, the Customer is required to check: - that the packaging is intact, not damaged, nor wet or, in any case, altered, even in the sealing materials (adhesive tape or metal strapping) - that the number of packages being delivered corresponds to what is indicated on the shipping label attached to the package. In any case, the courier is not required to have the purchased item inspected and cannot have the package opened to check its condition. Any damage or the mismatch in the number of packages or indications, must be immediately contested to the courier who makes the delivery, putting the words “withdrawal with reserve” on the appropriate accompanying document and confirmed, within 3 days to the email ordini@smitbowling.com.

If the packaging is damaged, the Customer will still collect the goods and then proceed to send photos and complaint in writing by email, fax or registered letter with acknowledgment of receipt to SMIT BOWLING within 3 days of receipt. Any report beyond these deadlines will not be taken into account and it will not be possible to activate the practices of reimbursement. For each statement, the Customer assumes full responsibility for what is stated.

Shipping Charges:
The sheet is purely informative and to know the actual cost of shipping, the purchase procedure must be carried out.

The cost of shipping may vary depending on the weight/volume ratio.
For delivery to Calabria, Sicily, Sardinia, Venice and the smaller islands, a surcharge of € 5.00 (per quintal weight/volume) will be applied.

Withdrawal Right

Pursuant to Articles 64 et seq. of Legislative Decree 206/05, if the customer is a consumer (i.e. a natural person who buys goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form a reference to VAT), has the right to withdraw from the purchase contract for any reason, without explanation and without penalty. To exercise this right, the customer, within 14 calendar days from the date of receipt of the goods, must notify SMIT BOWLING that they wish to exercise the right of withdrawal by sending a communication to the email address ordini@smitbowling.com.


The following data must necessarily be indicated in the request:
- First and Last Name
- Number and date of the invoice or receipt and order number (detectable from the order);
- Item code(s) of those you intend to withdraw;
- Bank details on which to obtain reimbursement by bank transfer (IBAN code of the invoice or receipt holder). In the event that the holder of the invoice/receipt subject to the exercise of withdrawal does not have his own bank details, he may provide those of a family member or acquaintance making explicit mention of authorization to SMIT BOWLING.

The right of withdrawal is however subject to the following mandatory conditions:
- the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased (e.g.: accessories, parts, etc.);
- the right does not apply to sealed products once opened;
- the purchased good must be intact and returned in the original packaging complete in all its parts (including packaging and any documentation and accessory equipment: manuals, accessories, parts, etc.); to limit damage to the original packaging, we recommend, when possible, to insert it in a second box; in all cases, the affixing of labels or adhesive tape directly on the original packaging of the product must be avoided;
- the shipping costs relating to the return of the good are borne by the Customer;
- the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the Customer;
- in the event of damage to the goods during transport, SMIT BOWLING will notify the Customer of the incident (within 5 working days of receiving the goods in its warehouses), to allow him to promptly file a complaint against the courier chosen by him and obtain reimbursement of the value of the goods (if insured); in this case, the product will be made available to the Customer for its return, simultaneously canceling the request for withdrawal;
- SMIT BOWLING is not liable in any way for damage or theft / loss of goods returned with uninsured shipments.

The right of withdrawal lapses completely, due to the lack of the essential condition of integrity of the goods (packaging and / or its contents), in cases where SMIT BOWLING ascertains:
- the lack of the external packaging and / or the original internal packaging;
- the absence of integral elements of the product (accessories, manuals, parts, ...) or anomalies in the product itself;
- damage to the product for reasons other than its transport.
In the event of forfeiture of the right of withdrawal, SMIT BOWLING will return the purchased goods to the sender, charging the latter the shipping costs.

Within 14 days of receiving the goods, the Customer must return the products subject to withdrawal, in perfect condition, in the original packaging and complete with all accessories supplied at the time of purchase, together with the purchase document. To limit damage to the original packaging, we recommend, when possible, to place it in a second box.

Except for any repair costs for damages found to the original packaging, SMIT BOWLING will refund the Customer the entire amount already paid including any shipping costs of the goods incurred during the purchase phase within 14 days of the return of the goods, using the same means of payment used by the Customer for the initial transaction unless the Customer expressly requests a different means.

Privacy The personal data requested when placing an order are collected by SMIT BOWLING and processed on computer media, in order to satisfy the obligations arising from the contract concluded with the Customer and will not be transferred to third parties under any circumstances and for any reason. SMIT BOWLING guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code pursuant to Legislative Decree No. 196 of 30.06.03. The data controller is SMIT BOWLING SRL, via del Passetto n. 111/113 - 47897 Fiorentino (Republic of San Marino) in the person who has the legal representation. The Customer, at any time, has the right to withdraw consent to the processing of personal data by written communication to be sent to the registered office of SMIT BOWLING SRL. The Customer, who declares to have received the information pursuant to art. 13 and on the rights to which he is entitled, pursuant to art. 7 of Legislative Decree no. 196/2003, has the right to access their data according to the methods provided therein. Marketing communications will be sent only with the explicit consent of the Customer given together with the authorization for processing and sending in the online registration form

Refunds

All refunds to Customers following material sent that does not conform to that ordered will be made via bank transfer within 30 working days to the Customer's current account, who must promptly send their bank details to ordini@smitbowling.com to receive the refund.

Request for issuance of documents

In case the Customer requests a new issue of the transport document in order to benefit from the guarantee, he/she will simply have to send a request email to ordini@smitbowling.com. The copy of the document will be issued within 10 days of the request and will be sent by email.

Complaints

Any complaints must be sent to SMIT BOWLING via the "Contact Us" form or to the email ordini@smitbowling.com, after which the Customer will be contacted as soon as possible in order to resolve the problem.

Jurisdiction and applicable law

The sales contract between the Customer and SMIT BOWLING is deemed to be concluded in San Marino and regulated by the Sammarinese Law. For the resolution of civil and criminal disputes arising from the conclusion of this remote sales contract, the territorial jurisdiction is exclusively that of the Court of the Republic of San Marino.

The conditions contained in this document may be modified by SMIT BOWLING without prior notice and will be valid from the date of publication on the website www.smitbowling.com
